TERMS OF SERVICE & PRIVACY POLICY

1. ACCEPTANCE OF TERMS

By accessing or using any services offered by Raising Bilinguals DHH (including but not limited to the RB CLUB membership, individual consultations, workshops, programs, courses, digital products, and resources), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users, participants, and visitors of our website, programs, and services.

2. SERVICES PROVIDED

Raising Bilinguals DHH provides capacity building services for families raising deaf and hard of hearing children, including:

  • RB CLUB Annual Membership: A comprehensive capacity building program including group training sessions, individualized support access, resource library, and community connection

  • Individual Consultations: Teacher of the Deaf consultations (online and face-to-face where available)

  • Workshops and Training: Standalone workshops, masterminds, and training programs

  • Digital Products: Courses, programs, resources, templates, and downloadable materials

  • School and Childcare Training: Professional development for educators and early childhood professionals

All services are provided by Clare Best, a qualified Teacher of the Deaf, and are designed to build parent capacity to support their child's bilingual language development and navigate educational systems.

3. NDIS SERVICES

Where services are funded through the National Disability Insurance Scheme (NDIS):

  • Services are provided under NDIS line item 15_005_0118_1_32 at the approved rate of $193.99 per hour

  • Services are available to plan-managed and self-managed NDIS participants only

  • A separate Service Agreement is required for all NDIS-funded services

  • All NDIS services comply with the NDIS Code of Conduct and NDIS Pricing Arrangements and Price Limits

  • NDIS-funded services are GST-free

4. RB CLUB MEMBERSHIP TERMS

4.1 Annual Commitment

RB CLUB membership requires a binding 12-month service commitment from the date of commencement. This commitment is required regardless of payment structure (annual, half-yearly, or quarterly installments).

4.2 Payment Structures

  • Annual Payment: $1,400 (one payment at commencement)

  • Half-Yearly Payment: $750 x 2 payments = $1,500 total

  • Quarterly Payment: $400 x 4 payments = $1,600 total

Installment payments represent your binding financial commitment to the 12-month service term and are structured payments toward your total annual service value.

4.3 Monthly Invoicing

Monthly invoices will be issued documenting services delivered each month. These may be submitted to NDIS/plan managers for claiming purposes.

4.4 Automatic Renewal

RB CLUB membership automatically renews annually unless written notice of non-renewal is provided at least 30 days prior to the renewal date.

4.5 Early Termination

If you terminate your RB CLUB membership before completing your 12-month commitment, you remain financially responsible for the full annual service commitment amount. Any payments already made will be applied toward this obligation, and the outstanding balance becomes due within 30 days of termination notice.

In cases of financial hardship, NDIS plan changes, or significant change in circumstances, we will work with you to find a reasonable solution.

5. PAYMENT TERMS

5.1 Payment Due Dates

  • Invoices are due within 7 days of issue date

  • RB CLUB installment payments are due as per your selected payment schedule

  • First payment for any service or membership is due upon booking/enrollment

5.2 Accepted Payment Methods

We accept payment via bank transfer, credit card, and NDIS plan manager payment arrangements.

5.3 Late Payment

Late payments may result in suspension of services until payment is received. Outstanding balances may be subject to debt collection processes.

5.4 NDIS Funding Changes

You must notify us immediately if:

  • Your NDIS plan is suspended, replaced, or ends

  • You no longer have sufficient NDIS funding for committed services

  • Your plan management arrangement changes

6. REFUND AND CANCELLATION POLICY

6.1 No Refunds

All payments are non-refundable once purchased. This includes:

  • RB CLUB membership fees and installment payments

  • Individual consultation sessions (pre-paid or packages)

  • Workshops, programs, and courses (digital or live)

  • Digital products and resources

6.2 Service Cancellations by You

  • Individual Consultations: Minimum 12 hours notice required. Cancellations within 12 hours of the scheduled appointment time will incur a 50% cancellation fee ($95)

  • RB CLUB Sessions: Live sessions are recorded. If you cannot attend live, you retain access to the recording

  • Workshops/Masterminds: No refunds for non-attendance. Recordings may be provided where available

6.3 Service Cancellations by Us

If we need to cancel or reschedule a scheduled session, we will provide at least 24 hours notice where possible and work with you to find an alternative time.

6.4 Service Period

All pre-paid packages, courses, and programs must be used within 12 months of purchase unless otherwise specified.

7. INTELLECTUAL PROPERTY

7.1 Ownership

All content, materials, resources, videos, templates, guides, worksheets, course materials, and intellectual property provided through our services remain the exclusive property of Clare Best / Raising Bilinguals DHH.

This includes but is not limited to:

  • RB CLUB resources, videos, and training materials

  • Workshop content and presentations

  • Course materials and modules

  • Templates, checklists, and guides

  • Methodologies, frameworks, and approaches

  • Website content, branding, and design

7.2 License to Use

When you purchase our services or products, you receive a personal, non-exclusive, non-transferable license to use the materials for your own personal use only in supporting your own child/students.

7.3 Prohibited Uses

You may NOT:

  • Share, distribute, or reproduce our materials with others

  • Upload our materials to file-sharing platforms or public websites

  • Use our materials for commercial purposes or to provide services to others

  • Modify, adapt, or create derivative works from our materials

  • Remove copyright notices or branding from our materials

  • Claim our materials, methodologies, or approaches as your own

7.4 Screenshots and Sharing

Limited screenshots or quotes for personal reference are permitted. However, systematic downloading, screen recording, or sharing of substantial portions of our content is prohibited.

7.5 Enforcement

Violation of intellectual property rights may result in immediate termination of services without refund and potential legal action.

8. TESTIMONIALS AND USER CONTENT

8.1 Permission to Use

By providing testimonials, feedback, success stories, or participating in interviews, you grant us permission to use your comments (with or without your name) in our marketing materials, website, social media, and promotional content.

8.2 Anonymity Requests

If you wish to remain anonymous, please let us know and we will honor this request.

8.3 Community Contributions

Content you share in RB CLUB forums, discussion threads, or community spaces may be visible to other members. Please do not share confidential or sensitive information.

9. PRIVACY POLICY

9.1 Information We Collect

We collect and process the following information:

  • Personal Information: Name, email address, phone number, location, NDIS participant number (where applicable)

  • Child Information: Child's age, hearing status, communication preferences (for service delivery purposes)

  • Payment Information: Payment details, invoicing information, ABN (where applicable)

  • Usage Data: Website analytics, email engagement, course/program progress, resource access

  • Communications: Email correspondence, support requests, feedback

9.2 How We Use Your Information

We use your information to:

  • Deliver our services and programs

  • Process payments and issue invoices

  • Communicate with you about your membership, bookings, and services

  • Send educational content, updates, and resources

  • Improve our services and offerings

  • Comply with legal and NDIS compliance requirements

9.3 Marketing Communications

By using our services, you consent to receive:

  • Service-related communications (invoices, booking confirmations, membership updates)

  • Educational content and resources related to raising bilingual deaf/hard of hearing children

  • Information about new programs, workshops, and offerings

You may unsubscribe from marketing emails at any time using the unsubscribe link in our emails. Service-related communications cannot be opted out of while you remain a client.

9.4 Information Sharing

We do NOT sell, trade, or rent your personal information to third parties.

We may share your information with:

  • Payment Processors: To process your payments securely

  • NDIS Plan Managers: Where you authorize us to invoice your plan manager

  • Email Service Providers: To deliver our communications (we use industry-standard secure platforms)

  • Legal Authorities: Where required by law

9.5 Data Security

We implement reasonable security measures to protect your personal information. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

9.6 Data Retention

We retain your personal information for as long as necessary to provide services to you and comply with legal obligations (including NDIS record-keeping requirements of 7 years).

9.7 Your Rights

You have the right to:

  • Access the personal information we hold about you

  • Request correction of inaccurate information

  • Request deletion of your information (subject to legal retention requirements)

  • Opt out of marketing communications

  • Lodge a complaint with the Office of the Australian Information Commissioner if you believe we have breached your privacy

9.8 Cookies and Analytics

Our website uses cookies and analytics tools to improve user experience and understand how our services are used. You can disable cookies in your browser settings, though this may affect website functionality.

10. DISCLAIMERS AND LIMITATIONS OF LIABILITY

10.1 Professional Services

Our services provide capacity building support and education for parents and caregivers. We do NOT provide:

  • Medical advice or diagnosis

  • Therapy directly to children

  • Legal advice

  • Hearing device prescription or fitting services

10.2 No Guarantees

While we strive to provide high-quality services and evidence-based information, we make no guarantees regarding specific outcomes or results from using our services.

10.3 Your Responsibility

You are responsible for:

  • Making informed decisions about your child's care

  • Implementing strategies appropriately for your child's individual needs

  • Seeking additional professional support where needed

  • Consulting with medical and allied health professionals for clinical matters

10.4 Limitation of Liability

To the maximum extent permitted by law, Raising Bilinguals DHH and Clare Best are not liable for any indirect, incidental, consequential, or special damages arising from use of our services.

10.5 Third-Party Links

Our website and resources may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of these third-party sites.

11. HEARING PARENT FOCUSED COMMUNITY

The RB CLUB is specifically designed for and limited to hearing parents raising deaf and hard of hearing children. This is to ensure we can provide appropriate, tailored support that reflects the unique experience of hearing parents navigating the bilingual journey.

We acknowledge our limitations in serving Deaf parents and believe they deserve dedicated spaces led by those within the Deaf community who share their lived experience.

12. CODE OF CONDUCT

All participants are expected to:

  • Treat others with respect and kindness

  • Maintain confidentiality of other members' personal information

  • Not engage in discriminatory, harassing, or abusive behavior

  • Not use our platforms for commercial solicitation

  • Support a bilingual philosophy aligned with our community values

Violations may result in removal from programs or services without refund.

13. MODIFICATIONS TO SERVICES AND TERMS

We reserve the right to:

  • Modify, suspend, or discontinue any service at any time

  • Update these Terms of Service with reasonable notice

  • Change pricing for new enrollments (existing commitments will be honored at agreed rates)

Significant changes will be communicated via email. Continued use of services after changes constitutes acceptance of modified terms.

14. FORCE MAJEURE

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, internet outages, or technical failures.

In such cases, we will make reasonable efforts to provide alternative delivery methods or reschedule services.

15. GOVERNING LAW

These Terms of Service are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms of Service, together with any Service Agreement you have signed, constitute the entire agreement between you and Raising Bilinguals DHH regarding use of our services.

19. ACKNOWLEDGMENT
